On the run and with three countries seeking his arrest, the captain of an anti-whaling group is claiming Germany was ready to sacrifice him to Japan and that a former crew member convicted by Japan had become a traitor by providing "false evidence."
Sea Shepherd Conservation Society founder Paul Watson said he was in "a safe place" after fleeing house arrest in Germany earlier this month when he learned that Japan was also seeking his extradition. Watson was being held on an earlier extradition request from Costa Rica.
With its own "Whale Wars" TV show on the Animal Planet network, Sea Shepherd is best known for its annual clashes with Japan's whaling fleet.
In 2010, Peter Bethune, the captain of one of its ships, was put on trial in Japan for boarding a Japanese whaling ship.
In his letter to supporters, Watson said Germany and Japan had conspired against him.
"The German government said I betrayed their trust by leaving Germany, yet they had already betrayed my trust," he stated. "The German politicians had made up their minds politically before the German court had made a decision, and during the time I was held in Germany, the Japanese negotiated with Germany to file for an extradition order to Japan on fabricated evidence provided by former Sea Shepherd Crewmember, Peter Bethune."
Watson then accused Bethune of cooperating "to provide false evidence to the Japanese Coast Guard to blame me for the boarding actions, despite the on-camera documentation that I specifically advised against the boarding by Bethune."

Bethune countered in comments to NBC News that "to blame me for his (Watson's) predicament is farcical."
"I had Paul's express permission to run the mission and board the Shonan Maru," he added. "For him to say he was against it or he ordered me not to is false. ?Japan has so much evidence against Paul -- various press releases, statements by Paul, footage."
"I have not seen any footage where he says don't go," Bethune said in response to?the allegation of video showing Watson advising him not to board. "Paul asked my to skydive off the helicopter onto the Nisshin Maru (another Japanese ship) for goodness sake."
Bethune was convicted but given a suspended sentence, and has since returned to his native New Zealand and started his own environmental group, Earthrace Conservation.
Watson was detained in Germany in May on a Costa Rican warrant accusing him of endangering the crew of a Costa Rican fishing vessel in 2002.

HSBC made an underlying profit of $6.8 billion in the first quarter.

In the beginning, the earth was without form, and void; and darkness was upon the face of the deep, as a giant cloud of gas and dust collapsed to form our solar system. The planets were forged as the nebula spun, jolted into motion by a nearby supernova, and in the center, the most rapid compression of particles ignited to become our sun. Around 4.5 billion years ago, a molten earth began to cool. Violent collisions with comets and asteroids brought the fluid of life ? water ? and the clouds and oceans began to take shape. It wasn?t until a billion years later that the first life was brought forth, filling the atmosphere with oxygen.
Over the next few billion years, single-celled organisms fused and became multicellular; body plans diversified and radiated, exploding into an array of invertebrates. Yet all this abundance and life was restricted to the seas, and a vast and bountiful land sat unused. Around 530 million years ago, there is evidence that centipede-like animals began to explore the world above water. Somewhere around 430 million years ago, plants and colonized the bare earth, creating a land rich in food and resources, while fish evolved from ancestral vertebrates in the sea. It was another 30 million years before those prehistoric fish crawled out of the water and began the evolutionary lineage we sit atop today. To understand life as we know it, we have to look back at where we came from, and understand how our ancestors braved a brand new world above the waves.
It was a small step for fish, but a giant leap for animalkind. Though, looking at modern fish species, it?s not so hard to envision the slow adaptation to life out of the sea. Just the other day, I was feeding my pet scorpionfish Stumpy, and he surprised me with this slow, deliberate crawl towards his food:
A number of fish exhibit traits which are not unlike those of the first tetrapods: the four-limbed vertebrates that first braved life on land, direct descendants of ancient fish. Many of Stumpy?s relatives, including the gurnards, are known for their ?walking? behaviors. Similarly, mudskippers have adapted anatomically and behaviorally to survive on land. Not only can they use their fins to skip from place to place, they can breathe through their skin like amphibians do, allowing them to survive when they leave their shallow pools. Walking catfishes have modified their respiratory system so much that they can survive days out of water. But all of these are only glimpses at how the first tetrapods began, as none of these animals has fully adapted to life on land. To understand how tetrapods achieved such a feat, we must first understand the barriers that lay between their life under the sea and the land above that awaited them.
Living in air instead of water is fraught with difficulties. Locomotion is one problem, though as evolution in a number of lineages has shown, not as big a problem as you might think. Still, while mudskippers and catfish seem to walk with ease, the same cannot be said of our ancestors. Some of the earliest tetrapods, like Ichthyostega were quite cumbersome on land, and likely spent most of their time in the comfort of water. These first tetrapods came from an ancient lineages of fishes called the Sarcopterygii or Lobe-Finned Fish, of which only a few survive today. As the name implies, these animals have meaty, paddle-like fins instead of the flimsy rays of most modern day fish species. These lobe fins, covered with flesh, were ripe for adapting into limbs.
But these early tetrapods had to develop more than a new way to walk ? their entire skeletons had to change to support more weight, as water supports mass in a way that air simply doesn?t. Each vertebrae had to become stronger for support. Ribs and vertebrae changed shape and evolved for extra support and to better distribute weight. Skulls disconnected, and necks evolved to allow better mobility of the head and to absorb the shock of walking. Bones were lost and shifted, streamlining the limbs and creating the five-digit pattern that is still reflected in our own hands and feet. Joints articulated for movement, and rotated forward to allow four-legged crawling. Overall, it took a long 30 million years or so to develop a body plan fit for walking on land.
At the same time, these cumbersome wanna-be land dwellers faced another obstacle: the air itself. With gills adept at drawing oxygen from water, early tetrapods were ill-equipped to breathing air. While many think that early tetrapods transformed their gills into lungs, this actually isn?t true ? instead, it was the fish?s digestive system that adapted to form lungs. The first tetrapods to leave the water breathed by swallowing air and absorbing oxygen in their gut. Over time, a special pocket formed, allowing for better gas exchange. In many fish, a similar structure ? called a swim bladder ? exists which allows them to adjust buoyancy in the water, and thus many have hypothesized that tetrapod lungs are co-opted swim bladders. In fact, exactly when tetrapods developed lungs is unclear. While the only surviving relatives to early tetrapods ? the lungfishes ? also possess lungs (if their name didn?t give that away), many fossil tetrapods don?t seem to have them, suggesting that lungfish independently evolved their ability to breathe air. What we do know is that it wasn?t until around 360 million years ago that tetrapods truly breathed like their modern descendants.
The other trouble with air is that it tends to make things dry. You may have heard the statistic that our bodies are 98% water, but, as well-evolved land organisms, we have highly evolved structures which ensure that all that water doesn?t simply evaporate. The early tetrapods needed to develop these on their own. At first, like the amphibians that would arise from them, many tetrapods likely stuck to moist habitats to avoid water loss. But eventually, to conquer dry lands and deserts, animals had to find another way to keep themselves from drying out. It?s likely that many of the early tetrapods began experimenting with ways to waterproof their skin. Even more important was the issue of dry eggs. Amphibians solve the dryness issue by laying their eggs in water, but the tetrapods which conquered land didn?t have that luxury.
The solution to land?s dry nature was to encase eggs in a number of membrane layers, in what is now known as an amniote egg. Even our own children reflect this, as human babies still grow in an amniotic sac that surrounds the fetus, even though we no longer lay eggs. This crucial adaptation allowed animals to cut ties with watery habitats, and distinguishes the major lineage of tetrapods, including reptiles, birds and mammals, from amphibians.
These crucial adaptations to tetrapod skeletons and anatomy allowed them to conquer the world above the waves. Without their evolutionary ingenuity, a diverse set of animals, including all mammals, would not be where they are today. Yet still we barely understand the ecological settings that drove these early animals out of the sea. Did dry land offer an endless bounty of food not to be passed up? Perhaps, but there is evidence that our ancestors braved the dry world very early on, even before most terrestrial plants or insects, so it?s possible earth was barren. Were they escaping competition and predation in the deep? Or was land important for some yet undetermined reason? We may never know. But as we reflect upon our beginnings, we have to give credit to the daring animals that began the diverse evolutionary lineage we are a part of. While we may never understand why they left the water, we are thankful that they did.

IDC reported Friday that Samsung has extended its lead over Apple in smartphone sales, in part because its new Galaxy phones came out before Apple updated its iPhone.
Samsung's Galaxy S3 phones got good reviews when it came out late in the second quarter. Apple's iPhone 4S came out in October, and a new one isn't due until this fall. A drop in market share for Apple is typical several months after the release of an iPhone model.
Samsung and Apple dominate with nearly half of the worldwide market for smartphones.
Here are IDC's figures for worldwide smartphone unit sales and market share in the second quarter of 2012:

? Apple Inc., 26 million units, 16.9 percent share (18.8 percent a year earlier)

Irvine, Calif., July 26, 2012 Efforts to begin human clinical trials using stem cells to treat cervical spinal cord injury in the U.S. received a $20 million boost Thursday, July 26, from the state's stem cell research funding agency, the California Institute for Regenerative Medicine.
The award will be shared by Aileen Anderson and Brian Cummings, associate professors of physical medicine & rehabilitation at UC Irvine's Sue & Bill Gross Stem Cell Research Center, and Nobuko Uchida of StemCells Inc. in Newark, Calif. Anderson and Cummings proved that transplanting human neural stem cells discovered and developed by Stem Cells, Inc. into rodents with thoracic spinal cord injury could restore mobility. The CIRM award announced Thursday will fund the collection of data necessary to establish human clinical trials in the U.S.
"Our therapeutic approach is based on the hypothesis that transplanted human neural stem cells integrate into the injured spinal cord to repair the protective myelin sheath and spinal circuitry," Anderson said. "Any therapy that can partially reverse some of the effects of spinal cord injury could substantially change the quality of life for patients by altering their dependence on assisted living and medical care."
CIRM's governing board on Thursday gave authorized $150 million for eight teams at five institutions statewide. The projects backed are considered critical to the institute's mission of translating basic stem cell discoveries into clinical cures.
"CIRM's support for UC Irvine's efforts to advance novel stem cell-based therapies for a variety of diseases is extremely gratifying," said Peter Donovan, director of the university's Sue & Bill Gross Stem Cell Research Center. "This latest award for spinal cord treatment holds great promise. We are delighted."
About 1.3 million Americans suffer chronically from spinal cord injuries. In California, nearly 147,000 individuals are living with such damage, which can severely impair the movement, sensation and autonomic function of otherwise healthy people. Recovery from spinal cord injury is often limited, even after aggressive emergency intervention with steroids and surgery, followed by rehabilitation.
"That's crushing for anyone," Anderson noted. "It's very tough for patients and their families. We believe stem cell therapies could provide significant functional recovery, improve quality of life and reduce the cost of care for those with spinal cord injury. That's our goal."
Anderson's and Cummings' laboratory has a long history of collaboration with StemCells Inc. in addressing spinal cord injury, including studies that led to the world's first clinical trial of a neural stem cell therapy for chronic spinal cord injury. This Phase I/II clinical trial, currently under way in Zurich, recently reported positive safety data from the first cohort of treated patients and continues to enroll subjects.
"We are very encouraged by the preliminary results in these volunteers" Cummings said, "and we are excited to receive CIRM funding to enable us to extend this approach to those with cervical injuries and to patients in the U.S."

NYSUT, the state?s largest teachers union, has joined the growing call for Gov. Cuomo to veto a bill that would amend the criteria for the placement of special-education students.
The much-discussed bill would require that school districts consider a disabled student?s home and family environment when deciding where that student could be best educated. It would be easier for families to request that their child be placed in a private school?at public expense?rather than a public school.
In a letter to Cuomo?s counsel, NYSUT?s director of legislation, Stephen Allinger, fleshes out one of the most common reasons given by those opposing the bill: that it would contradict federal law. He writes:
?By introducing contradictory non-educational criteria in special education placement decisions by school districts, this legislation violates federal policy governing Free and Appropriate Public Education entitlement under P.L. 94-142, the Individuals with Disabilities Education Act.? That policy requires school districts to place children with special needs in a ?Least Restrictive Environment? (LRE) appropriate for a child?s educational needs.? Under federal law, LRE requires mainstreaming children with a disability with their non-disabled peers in a public setting to the maximum extent possible, which applies to both non-academic and academic programs.?
He later writes:
?Clearly, federal laws and regulations do not include ?home environment? as a permissible category for consideration of special education placement.
The legislation would create another obligation for school districts to consider when providing for a free appropriate public education for eligible students, potentially increasing expensive due process hearings. Furthermore, school districts are under considerable financial stress due to years of budget austerity and cannot afford the considerable expense of increased private placements when placements exist in a public setting appropriate to a child?s educational needs.?
For Orthodox Jewish groups that promoted the bill (and to Catholic groups that support it) the term ?least restrictive environment? means something very different: a more comfortable environment with people of similar beliefs and/or lifestyles. But it?s up to Cuomo to determine whether this definition can jive with federal law.
Cuomo got the bill on Friday and has 10 days, not counting Sundays, to veto or sign it. Sounds like a Wednesday deadline.

Excitation of neurons depends on the selected influx of certain ions, namely sodium, calcium and potassium through specific channels. Obviously, these channels were crucial for the evolution of nervous systems in animals. How such channels could have evolved their selectivity has been a puzzle until now. Yehu Moran and Ulrich Technau from the University of Vienna together with Scientists from Tel Aviv University and the Woods Hole Oceanographic Institution (USA) have now revealed that voltage-gated sodium channels, which are responsible for neuronal signaling in the nerves of animals, evolved twice in higher and lower animals. These results were published in "Cell Reports".
The opening and closing of ion channels enable flow of ions that constitute the electrical signaling in all nervous systems. Every thought we have or every move we make is the result of the highly accurate opening and closing of numerous ion channels. Whereas the channels of most lower animals and their unicellular relatives cannot discern between sodium and calcium ions, those of higher animals are highly specific for sodium, a characteristic that is important for fast and accurate signaling in complex nervous system.
Surprising results in sea anemones and jellyfish
However, the researchers found that a group of basal animals with simple nerve nets including sea anemones and jellyfish also possess voltage-gated sodium channels, which differ from those found in higher animals, yet show the same selectivity for sodium. Since cnidarians separated from the rest of the animals more than 600 million years ago, these findings suggest that the channels of both cnidarians and higher animals originated independently twice, from ancient non-selective channels which also transmit calcium.
Since many other processes of internal cell signaling are highly dependent on calcium ions, the use of non-selective ion channels in neurons would accidently trigger various signaling systems inside the cells and will cause damage. The evolution of selectivity for sodium ions is therefore considered as an important step in the evolution of nervous systems with fast transmission. This study shows that different parts of the channel changed in a convergent manner during the evolution of cnidarians and higher animals in order to perform the same task, namely to select for sodium ions.
This demonstrates that important components for the functional nervous systems evolved twice in basal and higher animals, which suggests that more complex nervous systems that rely on such ion-selective channels could have also evolved twice independently.

Production on Fox's sci-fi drama "Fringe" has been shut down for two weeks due to the illness of star John Noble.
Comic-Con 2012: 'Fringe' cast bids a tearful goodbye, reflects on five seasons (video)
A source with knowledge of the situation tells The Hollywood Reporter that the 63-year-old Noble, who plays scientist Walter Bishop on the show, is being treated for a sleep disorder. Noble's illness effectively shut down filming on the fifth and final season on Tuesday -- just one day after he was expected to appear on the Television Critics Assn. press tour panel with Anna Torv, Joshua Jackson, Lance Reddick and showrunner J.H. Wyman.
The delay was initially said to be only three days, but sources now say it will be extended to nine shooting days, until about Aug. 7.

Noble's absence was addressed during the Fringe session at the Television Critics Association gathering on Monday, with Wyman telling reporters that the actor was "under the weather."
Filming on the season five premiere began last Wednesday in Vancouver and continued Thursday and Friday. Production on the series was paused Monday so cast members could attend TCA.
Separately, on Tuesday a source confirmed to THR that production had been impacted by co-star Jasika Nicole's car accident, in addition to multiple illnesses in the cast.
The extended delay is not expected to impact the series' Sept. 28 premiere date.
The news comes after castmates and Wyman publicly lauded Noble, who appeared at Comic-Con on July 15, for his work on "Fringe" and discussed his Emmy snub for his complicated performance on the sci-fi series.
