Video: Zimmerman?s past brush with law enforcement

>>> the shooting death of trayvon martin. tonight, new information has come into light about the shooter, george zimmerman , specifically his behavior in a previous run-in with the law. we get the exclusive details from our national investigative correspondent michael isakov from sanford, florida.

>> when george zimmerman was questioned by police after the trayvon martin shooting, it wasn't the first time he had been in custody. in july 2005 , he was arrested in orlando for resisting a florida law enforcement officer and obstructing justice. this police report obtained by nbc news states he used violence and battery upon the officer. the lead prosecutor on the case said today zimmerman could have been charged with a felony.

>> i have seen people charged with less conduct than mr. zimmerman is alleged to have done that night at the bar.

>> the incident took place at this college bar where an undercover alcohol control officer was arresting several employees for serving alcohol to minors. they showed their badge and asked zimmerman to leave the area. i don't care who you are, he said. after being asked to leave again, he said, f-you. the felony charges were reduced to a misdemeanor, and the court ordered him into anger management classes.

>> the program recognizes that sometimes people get arrested and they're not bad people , they're people who made a mistake.

>> florida officials said if he had been convicted of a felony as originally charges in 2005 , he wouldn't have been able to obtain a concealed weapons permit. zimmerman 's attorney did not return repeated calls for comment.

Heejun Han Soothes Jennifer Lopez After 'Idol' Exit: 'It's OK, Baby'

'Those judges suck, but Jennifer is awesome,' latest 'American Idol' castoff laughs to MTV News.
By James Montgomery, with reporting by Kelly Marino

No joke: Heejun Han got the boot on Thursday night's "American Idol," bringing his odd, occasionally hilarious run to an end.

And while his exit didn't come as a shock to most, it was rather odd that it came on the heels of his best performance, a smooth take on Donny Hathaway's "A Song for You," which earned him praise from the judges and a standing ovation from the studio audience.

But if you think Han is taking all this personally, well, then you probably haven't been paying attention to his antics. Because after his exit, he was all smiles, as MTV News found out firsthand.

"I would be sad if I were to go home when I was [in the] top nine, top seven, top six — I would be so sad anyways," he said. "But, you know, I'm just happy, because I finished really great, and I feel like I proved a lot of things to the world, so I'm kind of in an excited place, actually."

In typical Han fashion, he was still making the most of his time in the spotlight, using our microphone to praise his paramour, Jennifer Lopez — who seemed to be the lone judge determined to save him after he was voted off — and take a few joking swipes at frequent nemesis, mentor Jimmy Iovine.

"Jennifer actually came up to me and said, 'I really, really tried to save you, but they wouldn't listen to me!' and I said, 'It's OK, baby, it happens all the time.' Those judges suck, but Jennifer is awesome," he laughed. "[And] Jimmy Iovine needs to get himself a new pair of glasses and new hat, because he's been wearing that for a fricking long time. No, Jimmy was a great mentor, I respect him a lot. I [just] hope I don't see him anytime soon, because I've been talking a lot of crap about him."

While Han is slightly sad that his time on "Idol" is over, he said he has no regrets about anything he did on the show, mostly because he only auditioned to prove a point: that anyone can accomplish their goals if they put their mind to it. And he'll continue spreading that message.

"I started off this competition to prove to the world that, if you really believe in yourself, you can become someone regardless of who you are ... and that's what I did, that's what I proved," he said. "I never thought I could be a star or anything like that, and I'm not yet, but I want to take this chance to make something out of it, to prove to more people that you can become someone."

Get your "Idol" fix on MTV News' "American Idol" page, where you'll find all the latest news, interviews and opinions.

International scientific community issues first State of the Planet Declaration

Scientists issued the first "State of the Planet" declaration at a major gathering of experts on global environmental and social issues in advance of the major UN Summit Rio+20 in June.

The declaration opens: "Research now demonstrates that the continued functioning of the Earth system as it has supported the well-being of human civilization in recent centuries is at risk." It states that consensus is growing that we have driven the planet into a new epoch, the Anthropocene, where many planetary-scale processes are dominated by human activities. It concludes society must not delay taking urgent and large-scale action.

"This is a declaration to our globally interconnected society," said Dr Lidia Brito, director of science policy, natural sciences, UNESCO, and conference co-chair.

"Time is the natural resource in shortest supply. We need to change course in some fundamental way this decade," she added.

Over 3,000 experts in climate change, environmental geo-engineering, international governance, the future of the oceans and biodiversity, global trade, development, poverty alleviation, food security and more discussed the intricate connections between all the different systems and cycles governing our ocean, air, land and the human and animal life dependent on those environments.

Dr Mark Stafford Smith, Planet Under Pressure conference co-chair, said, "In the last decade we have become a highly interconnected society. We are beginning to realise this new state of humanity can be harnessed for rapid innovation."

"But we need to provide more open access to knowledge, we need to move away from GDP as the only measure of progress, and we need a new way of working internationally that is fit for the 21st century," he added. "This conference has provided new ideas and practical solutions for the way forward."

The declaration concludes that, "a highly interconnected global society has the potential to innovate rapidly. The Planet Under Pressure conference has taken advantage of this potential to explore new pathways."

But, say Brito and Stafford Smith, effective planetary stewardship also requires: "More ways of participation at all levels, stronger leadership in all sectors of society; greater connectivity between those generating new knowledge and the rest of society; and rethinking the roles of science, policy, industry and civil society."

The conference presented new initiatives as recommendations for the Rio+20 Summit:

  • Going beyond GDP by taking into account the value of natural capital when measuring progress.
  • A new framework for developing a set of goals for global sustainability for all nations.
  • Creating a UN Sustainable Development Council to integrate social, economic and environmental policy at the global level.
  • Launching a new international research programme, Future Earth, that will focus on solutions.
  • Initiating regular global sustainability analyses.

The conference also previewed the first Inclusive Wealth Report, developed by UN University's International Human Dimensions Programme (UNU-IHDP) and the UN Environment Programme.

Based on a new economic indicator that measures natural, human and produced capital, the tool goes beyond GDP and can provide guidance for economic development towards sustainability.

Says Professor Anantha Duraiappah, Executive Director of UNU-IHDP: "Until the yardsticks which society uses to evaluate progress are changed to capture elements of long-term sustainability, the planet and its people will continue to suffer under the weight of short-term growth policies."

The report, scheduled to be published at Rio+20, will describe the capital base of 20 nations: Australia, Brazil, Canada, Chile, China, Colombia, Ecuador, France, Germany, India, Japan, Kenya, Nigeria, Norway, the Russian Federation, Saudi Arabia, South Africa, USA, United Kingdom and Venezuela.

Off the back of the declaration and recognizing the interconnectedness of the current challenges, the four major international research programmes under ICSU that direct global environmental change science (the International Geosphere-Biosphere Programme; DIVERSITAS; the International Human Dimensions Programme; and the World Climate Research Programme) aim to rapidly reorganize to focus on global sustainability solutions.

Additionally, the programmes are proposing to develop platforms that facilitate cooperation with all sectors of society to develop a new strategy for creating and rapidly translating knowledge into action. "Such interactions should be designed to bring societal relevance and trust to science-policy interfaces, and more effectively inform decision-making to keep pace with rapid global change," reads the declaration. This strategy will form part of "a new contract between science and society" and includes the launch of a new international research programme, Future Earth.

The Planet Under Pressure conference marked the beginning of this new shift in direction, according to the conference co-chairs.

Delegates in London were joined by almost 8,000 people online worldwide and reached more than a million people through social media in the first three conference days.

Dr Brito said, "We have a positive message: strong leadership from all sectors and harnessing the increased connectivity offers some hope that the risk of long-term environmental crises can be minimized."

"This new connectivity is the beginning of how the scientific community needs to operate. We need a powerful network of innovation, North and South. This approach needs to be part of our DNA from now on," she added.

In recorded remarks, UN Secretary General Ban Ki Moon said today that "climate change, the financial crisis and food, water and energy insecurity threaten human wellbeing and civilization as we know it."

"My High-level Panel on Global Sustainability has just recommended that I consider naming a chief scientific advisor or establishing a scientific board to advise me and other organs of the United Nations.

"I also intend to engage the scientific community on other projects, such as the Global Sustainable Development Outlook report," he added, "I am also ready to work with the scientific community on the launch of a large-scale scientific initiative."

UN Rio+20 Executive coordinator, Elizabeth Thompson, said, "politician or public servant, scientist or citizen, community or company, we are the shareholders of Earth Incorporated and have a joint responsibility to protect our common patrimony."

"The scientific community can help us make sense of these complex and interconnected challenges."

Conference delegates also heard how research advances in the previous decade have shown humanity's impact on Earth's life support system has become comparable to planetary scale geological processes such as ice ages. "Consensus is growing we have driven the planet into a new epoch, the Anthropocene, in which many Earth system processes are now dominated by human activities," the declaration states.

This new force risks pushing parts of the Earth system the sum of our planet's interacting physical, chemical, and biological processes including life and society past so-called tipping points.

Tipping points include the disappearance of summer sea ice in the Arctic, permafrost in Arctic regions releasing large quantities of greenhouse gases into the atmosphere, and the drying out of the Amazon rainforest. If these tipping points are crossed they can increase the likelihood of going beyond other thresholds generating unacceptable and often irreversible environmental change on global and regional scales with serious consequences for human and all forms of life on the planet.

The declaration stated that existing international arrangements are failing to deal with long-term development challenges such as climate change and biodiversity loss in an interconnected way indicating that it would be a mistake to rely on single international agreements. Research indicated that comprehensive sustainability policies at local, sub-national, national, and regional levels should be encouraged to provide "essential safety nets should singular global policies fail."

Summary of the USPTO proposals for challenging issued patents ...

One of the more significant developments in patent law over the past two months was the USPTO?s proposal of?new rules for post-grant opposition proceedings?under the America Invents Act. ?The rules, proposed on February 9 and 10, 2012 in a series of Federal Register notices, will establish the following new proceedings for challenging patents and patent applications:

  • inter partes review (IPR), which may be used to challenge the validity of an issued patent on the basis of prior art patents or published applications;
  • post grant review (PGR), used may be used challenge the validity of an issued patent on any basis within 9 months of its grant;
  • a transitional program for covered business method patents (CBM), a variant of PGR that may be used by an entity who has been sued or charged with infringement of a patent covering data processing operations used in the management of a financial transaction or service;
  • derivation proceedings, which may be used by an inventor who claims that the invention covered by a co-pending application was derived from the inventor.

In each program listed above, any person may request a proceeding by filing a petition for review with the Patent Trial and Appeal Board (PTAB). ?The PTAB will notify the patent owner, who may file a preliminary response within two months. ?Then, if the Board determines that the petition meets the required criteria, it will initiate a trial to review the patent or application at issue.

Each of the proceedings will follow the general format of a trial, with the petitioner and patent owner each having a period for discovery, and an oral hearing at the end of the discovery period. ?Petitioners can request that certain information in the petition be kept confidential and filed under seal. ?The time required to obtain a decision in each proceeding can be as much as 15 months, although the parties may terminate a proceeding by written agreement at any time before the PTAB reaches a final decision.

The USPTO will grant a petition if it meets the applicable standards, which are:

Day Trade Forex Successfully | Finance information

set out your rules first

An Overview

So, you want to make big bucks trading the markets? We?ve all heard the stories of how fortunes were made in the time it takes to say ?where?s the keys to my Porsche?? But can it be done? Well ? maybe. And you want a piece of the action, yes? And I do not blame you. Trading for a living, for me, is the best occupation there is. No boss, no overheads to speak of, work when you want, anywhere you want, freedom, just you, the computer, and your plan. Plan? What plan?

Of course, ?plan?. Anything in life worth doing must have a plan of sorts. Trading is no different. In fact trading without a plan is asking for trouble of the most serious kind, financially speaking. You must have a plan. Read on. The content of this document has been very modest the subject of many books, studied in depth by vivid the very best of us, and will be debated for years to come. My aim here is to plant a seed that will hopefully steer you in the right direction saving you countless dollars Malthus, not to mention heartache and ruin. Before you start to lay your hard-earned money on the line , there are many, MANY, things that need to be taken into consideration. The very first lesson to learn quickly is that the guys and gals who trade the markets for a living, the professionals, are not going to think twice about taking that money from you. They know all the tricks in the book, and a few more to boot. The idea is to act and think like those professionals and eventually become one. The profits will then begin to flow. If you have no idea what you are doing, then you may as well just mail a check to those above-mentioned professionals and leave it at that, saving a lot of time.

On the other hand, after losing ?quite a bit ?in the markets, I copied them and you could do the same. Learn tricks their. In short, study, study some more, then continue studying. As they say, ?knowledge is a powerful thing.?

Everything will then fall into place. Where do I start?

trading is very, very easy. Making a consistent profit is not ? unless you have the plan we talked about earlier, a master plan. You need to learn, and sustain, some good habits. The primary weapon in your arsenal in fighting your opponents is getting the odds in your favor. Gaining on EDGE. Just like the casinos. Take a look at the house edge in the casino and how small it is. Something like 2.5%, this is enough to make them a fortune over time! It?s just the same with the forex trading markets, get yourself an ?edge?.

Let?s stay with the casino example for a moment. They often have losing days when a punter will win big, but at the final reckoning, those boys will be in the money. And that is because of the ?edge?. Your edge starts here. It?s not one item to concentrate on but your whole approach to trading. Sound complicated? Not really, when you break it down into its component parts. We?ll do this now with headings and sub-headings. There really is no point in doing this exercise if you only pay lip service to it. You must follow your rules because they will get you into the money, no argument. Rules

There?s no point in having trading rules if you don ? t follow them gold, Which brings us very nicely to our only rule.

FOLLOW YOUR RULES DEFINED Rigidly

This rule may sound silly but think about it, how often do you break minor rules in some other pursuit investigated as driving, sports, work? . Sometimes it can be costly, it can be in forex very expensive indeed, account-wise

My forex rules are split into three sections, you may wish to do the same:

a) General ? similar to laws

b) Trading ? similar to regulations

c) system ? well, actually trading rules when your system

Remember, this is a very short article on the ways that I have tackled the problem of gaining on edge in my trading, and in trying to emulate the professionals. This is by no means the only way, so you will need to address your trading in a similar manner traits to extract those profits from the market that we all aspire to. Let?s look at the general rules.

The reason you are reading this is because you want to make money. I have been in your shoes doing exactly the same thing, but at the wrong end of account at ? 8,000. Yes, all gone! It was not the first account that I had delivered to ?the professionals? so something HAD to be done. I made rules and divided them into sections, analyzing them yet further. Here are my general rules that you may want to consider:

a) General rules

? Work / study hard continuously, knowledge is essential, but

? Strike a balance, have a life. Trading at all times will make you stale

? Take responsibility for every decision that affects your trading

? Self-belief in your aim, in what you are trying to Achieve

? Do you want to trade full time or part time, how many hours per day?

? What IS your aim, what do you want to get out of it, know yourself?

The only place where ? success comes before work is in the dictionary

? Treat trading as a business and seeking Organise it as

A whole book could be devoted to just the above section, can not delve too deeply this article into what only you can answer for yourself. Please take the time to write down your rules and how you will address them. Your trading will evolve for the better I assure you.

b) trading rules

? What type of trader am I, do I want action, stress etc? ?

p> ? Have a system that fits your trading style

? Become good at one style, tweak it to suit you

? Keep an open mind for each and every trade

Do not form opinions

? on the market, let it tell you where it?s going

? Do not listen to the opinions of others

? The words ?hope? and ?wish? are not in your trading vocabulary

? trade with money that is not indispensable, can you afford to lose it?

? Learn to take losses as part of the business, learn from them

? Take regular breaks from trading

? Do not over commit yourself, not too many open positions

not stand aside

? if you are sure about a trade

? Do not add to losing positions

? Keep the dollar signs away, try to score points

? Without fail, have a trading and-trade plan that plan

That load point in the list brings us to our final section in honing our trading skills, and making a living from trading the currency markets.

c) System rules

Most aspiring traders hope to win on every trade. This is just not possible and there will be losing trades. It is a fact of trading life. It should not be taken as a failing of your rules or system when these occur. Rather, it highlights how good your rules are in dealing with those losses. The aim is to win more than you loose by Utilizing the ?edge? Described in the previous paragraphs. This ?edge? is gained by following your rules religiously, coupled with a trading system that suits your style. I have managed to do this after almost ten years of trading and using many differing systems, styles, and techniques. We will add to your edge in this section. As a minimum your system should include:

? What time frame you want to be trading

? The times not to trade

? Clear and unambiguous means of entry Into the trade

? The reasons for entering and exiting the trade

? What your means of exiting the trade will be

? What size should your stop loss be

? Will you use trailing stops

? What position will you use size

? Dealing with news announcements?

? Will you scale out of the position, etc., etc.

Each system has its own merits (or lack of) on dealing with the problems presented by the markets on a daily basis. Another example that I want to mention is my own unwritten rule that I never trade on the first Friday of every month, this is when the NFP report is released and the markets Tend to be a little too volatile for me. This is a lesson that I have learned the hard way (and I?ve paid handsomely for that lesson).

You can see, then, that your rules can evolve as your trading experience grows. You will then see that you will become more confident in your trading as you add rules to your overall trading system Sometimes though these rules will be added after experiencing some drawback, or even a minor disaster, but this is all part of the learning process . You can bet your bottom dollar that the top traders amongst us have suffered a disaster or two along the way. The idea is to learn from those mistakes. The trouble is that it?s difficult to learn a lesson by the written word alone. Some form of interaction is best in order to FIRMLY plans that lesson in our brain. This is where experience comes in. But, I FIRMLY believe that these pages will get you started on the right path My own system has very clear rules on the items mentioned above, plus many more, keeping me out of trouble when my money is on the line. Before I even pulled up a chart onto my computer, I started by asking myself what I actually wanted my new system to address by making a list. I already had most of the general, and trading rules in place, in fact I have added to them fairly recently, but I wanted a whole new set of rules system. These are the items on my list that enabled me to build a new, easy to use, profitable system:

? First and foremost it must trade with the trend

? Must Be Good for all currency pairs

? Must be good for all time frames

? Must try to get me into the big moves of the day

? Must be user Friendly

? Must be simple

? Must utilize more than one of my strategies on the same chart

? Must keep losses to a minimum

? Must enable decision-making at a glance

? I must be able to use aggressive / non-aggressive tactics

? Must have a higher time frame trend and confirmation

? Must have clear and unambiguous accurate entry signals

? Must also give clear signals re-entry into trends

? Must tell me when to exit

? Must have multi-timeframe trading on one chart

? Must give an audio alarm when signals are generated (important)

? Must stop me from over trading (important)

? Must stop me from fishing for tops and bottoms (important)

Do not take any part of this set-up lightly, as it will definitely pay dividends at a later stage of the whole process. The last two items on the list had cost me dearly in the past. The audio alarm is to call me to the computer when a trade presents itself, this way I do not need to stare at the screen all day. No more missed opportunities. Perfect.

The biggest task was to convert those ?must haves? into a working system that enabled me to trade for a (profitable) living. This has been achieved after no small amount of work, blood, sweat, and tears! In some small way, I hope that I have given you a base on Which to build your own trading strategy. The Black Dog Trading Strategy goes from strength to strength. I wish you all the luck in your trading Endeavors. id=?article-resource?> to by-pass that final stage and use a system that has been created from the points listed above, then please drop by my website to view for. yourself

METAIRIE, La. (AP) ? Mitt Romney on Friday looked to pre-empt Supreme Court arguments that will shine a spotlight on a key vulnerability for him in the Republican primary ? health care reform.

Romney called Democratic President Barack Obama's signature overhaul "an unfolding disaster for the American economy, a budget-busting entitlement and a dramatic new federal intrusion into our lives."

Romney was marking the second anniversary of the signing of the health care law, which requires all Americans to pay insurance or face a tax penalty. That mandate to buy insurance has become a focal point for conservative anger, and critics say it represents unwanted or even unconstitutional government intrusion.

Romney, though, signed a health reform law as governor of Massachusetts that required everyone in the state to buy insurance, legislation that became the model for the national overhaul. Romney's support of the Massachusetts law has fueled conservative criticism against him. Skepticism about his health care record, combined with moderate positions he's taken on other issues in the past, is part of what's contributing to Romney's struggle to wrap up the GOP nomination.

The White House on Friday released a report highlighting the benefits of the overhaul, including a provision that makes it illegal for insurance companies to refuse to cover people who have pre-existing medical conditions.

In a written statement, Obama said the law "has made a difference for millions of Americans, and over time, it will help give even more working- and middle-class families the security they deserve."

The health care law is unpopular with voters. An AP-GfK poll conducted in February found that overall, 35 percent of Americans say they support the health care reforms Congress passed two years ago, while 47 percent oppose it.

Coming up next week are three days of arguments in the Supreme Court over whether the overhaul, particularly the requirement to buy insurance, is constitutional. Among other options, the justices could uphold the law, strike it down completely or get rid of some provisions.

The arguments are likely to shine a spotlight on Romney's own health care record in Massachusetts.

As governor, Romney signed a health care law that requires everyone in Massachusetts to buy insurance or pay a penalty. The law ended up covering most of the uninsured in the state, but health care costs have risen in the years since it was passed. Critics have dubbed it "RomneyCare," and the plan inspired the national law.

In addition to a mandate to buy insurance, both Romney's law and the national plan include special marketplaces to buy insurance, as well as a series of requirements that health plans have to meet in order to sell plans there.

Romney has refused to disavow the Massachusetts legislation, instead saying that it was the right plan for his state. He says he has never believed it should have become a national model and insists states should be allowed to come up with their own solutions to health care problems.

"Different states have created different approaches, and I will return to states the responsibility for caring for their own uninsured," Romney said Friday as he campaigned in Louisiana.

Still, Democrats were quick to point out that Romney has previously suggested his Massachusetts law could become the basis for a national plan. "Lessons we learned in Massachusetts could help Washington...find a better way," Romney in 2009 wrote an opinion piece in USA Today. Obama campaign strategist David Axelrod has pointed out that the White House used Romney's plan as a model for the national legislation.

"Gov. Romney was an early supporter of the individual mandate, and as governor put a mandate in place to ensure all Massachusetts residents were taking responsibility for their own health care and everyone could get covered at a lower cost," Obama campaign spokesman Ben LaBolt said in a statement. "He called his health care reform plan a national model."

Romney says that his plan was right for his state, but insists it shouldn't have become the basis for a national plan.

If Obama intended to use the Massachusetts law as a model, "Why didn't he call me?" Romney routinely says when he's asked about the issue at campaign stops.

The individual mandate was originally proposed by a conservative think tank as an alternative to the national health plan that then-First Lady Hillary Clinton was proposing in the mid-1990s. Republican presidential candidate Newt Gingrich, then the Speaker of the House, backed the idea at the time.

Now, the public remains broadly opposed to an individual mandate. Six in 10 say they oppose a law that would require every American to have health insurance or pay a penalty if they don't. Just 34 percent support a mandate for individuals to have health insurance.

There are other provisions that are more popular. The health law also made it illegal for insurance companies to deny health coverage to people because of pre-existing medical conditions.

Still, that requirement is part of why the mandate is also included in the law ? it makes sure that young, healthy people are buying insurance even if they don't need very much medical care. That brings down insurance costs for everyone. A mandate also keeps people from using emergency room care when they don't have insurance.

Romney recognized those realities at the state level. "Getting every citizen insured doesn't have to break the bank," he wrote in the 2009 opinion piece. "Using tax penalties, as we did, or tax credits, as others have proposed, encourages 'free riders' to take responsibility for themselves rather than pass their medical costs on to others."

IPBiz: O'Malley's dissent in Byrne in the legal malpractice area

In Byrne v. Wood, Herron , on the subject on legal malpractice cases in the patent area [PETITION FOR REHEARING EN BANC denied ], Judge O?MALLEY authored a lengthy dissent, arguing against federal jurisdiction.

From the dissent, giving background on the case:

The gist of Byrne?s malpractice case is that defendants negligently failed to secure broader patent protection for his invention from the United States Patent and Trademark Office (?PTO?), and, as a result, Byrne was unsuccessful in a subsequent patent infringement lawsuit against Black & Decker Corporation and related entities (collectively, ?Black & Decker?). See Byrne v. Black & Decker Corp., 2007 WL 1492101 (Fed. Cir. May 21, 2007). All agree that Byrne?s claim is a purely state law claim for which federal law creates no cause of action.

AND

On appeal to this court, a majority of the panel agreed that our current case law extended ? 1338 jurisdiction over this action but noted that, because it is inconsistent with Supreme Court precedent, that case law should be revisited. See Byrne v. Wood, Herron & Evans, LLP, 2011 WL 5600640, at *5 (Fed. Cir. Nov. 18, 2011) (?Although we must adhere to our precedent, we believe this court should re-evaluate the question of whether jurisdiction exists to entertain a state law malpractice claim involving the validity of a hypothetical patent . . . .? (emphasis in original)). The panel then reluctantly resolved the merits of the appeal, and this petition for rehearing en banc followed.

Words of Justice Oliver Wendell Holmes, Jr. show up in footnote 2 of the dissent. Footnote 3 begins: See also IMT, Inc. v. Haynes & Boone, L.L.P., 1999 WL 58838 (N.D. Tex. Feb. 1, 1999) (remanding a legal malpractice claim to state court where the plaintiff alleged that its attorney?s negligence in filing a continuation-in-part patent application instead of a new patent application raised questions about the patent?s validity and enforceability);

Of the year 2007:

In 2007, the Federal Circuit weighed in on this issue in what one commentator has described as a ?substantial shift in the view of whether federal or state courts have jurisdiction over patent-related legal malpractice claims.? Robert W. Hesselbacher, Jr., Which Court Decides? Legal Malpractice Claims Arising from Patents, 51 No. 5 DRIFTD 32 (May 2009). In that year, a single panel of this court issued two decisions on the same day that, according to the panel, resolved an ?issue of first impres- sion? ? i.e., whether ? 1338 jurisdiction exists where a legal malpractice claim requires resolution of an underly- ing question of patent law. See Air Measurement Techs., Inc. v. Akin Gump Strauss Hauer & Feld, L.L.P., 504 F.3d 1262 (Fed. Cir. 2007) (?AMT?); Immunocept, LLC v. Fulbright & Jaworski, LLP, 504 F.3d 1281 (Fed. Cir. 2007).

Dining With Diabetes ? The Sampan Newspaper

Many, if not most, people spend a lot of their time thinking about the food they are eating. How many calories? How much fat? How many carbohydrates? All are questions we ask ourselves often. But for diabetics, keeping an eye on the nutritional value and quantity of food you eat is especially important. However, diabetes does not have to limit the choices you have when dining. In fact, most recipes don?t have to change much at all when shaping your diet around your body?s needs. But there are a few lifestyle and dietary choices that require some extra caution:

Alcohol

If you were one to enjoy a glass of red wine with your food, or were the type that likes a cold beer with a meal, a diagnosis of diabetes does not need to change things. But before you carry on with your ritual, check with your doctor about whether it is safe for you to drink alcohol. Even with a doctor?s approval, it is better to air on the safe side, so limit the amount of alcohol you drink, and always eat when drinking. That way, your body has something to work with.

The reason why a diabetic should limit their intake of alcohol is because hypoglycemia ? the condition where the body?s blood glucose level falls below 70 mg/dL ? can be caused shortly after drinking, and can last for 8 to 12 hours after drinking. Therefore, it is important to check your blood glucose level before you drink, and make sure that you eat while drinking so that your blood glucose level doesn?t drop too low.

Another issue with drinking alcohol is that the symptoms of hypoglycemia ? dizziness, sleepiness and disorientation ? can be construed as drunkenness. The best way to make sure somebody doesn?t misconstrue the two conditions is to always carry an Identification Card (I.D.) that states that you are diabetic. Finally, drinking alcohol can lessen one?s desire to stick to a healthy and diabetic-friendly diet.

Eating Out

Eating out is usually a great experience. However one of the most important things to remember if you are diabetic is not to overeat when dining out. Always try to make sure that you eat the same amount of food as you would at home. Ways to do this include sharing your food with your dining partner or packing the remainder of the food in a container and bringing it home. Eating a consistent amount of food helps with the tracking of your blood glucose level.

Never be afraid to ask your waiter about things you don?t understand on your menu or tell your waiter about preferences you have with your food. For example, if your diet focuses on low salt intake, tell you waiter so he can inform the chef not to add salt to your food. Discipline is important when dining out as the food choices you make can have large consequences later.

Another important aspect to staying healthy is to eat at the right times. For a diabetic, eating at the right time makes things like blood glucose levels easier to track and control. Don?t be afraid to ask your friends to eat at times that are appropriate for you. If needed, call restaurants ahead of time so that they can prepare your food before you arrive, further keeping your routine intact. If you really cannot avoid eating later than usual, eat a snack at the time you usually eat your dinner or lunch. That way, your body can still somewhat follow its routine ? you might have to adjust your insulin intake to do this, though.

Tips on Controlling Your Order

? Always ask about items in your order that you don?t understand.

? Eat slowly.

? Ask for fish or meat broiled with no extra butter.

? Order your baked potato plain, then top it with a teaspoon of margarine or low-calorie sour cream, and/or vegetables from the salad bar.

? Ask for sauces, gravy and salad dressings ?on the side.?

? Order foods that are not breaded or fried because they add fat. If the food comes breaded, peel off the outer coating.

? Read the menu creatively. Order a fruit cup for an appetizer or the breakfast melon for dessert. Instead of a dinner entree, combine a salad with a low-fat appetizer.

? Ask for substitutions. Instead of French fries, request a double order of a vegetable. If you can?t get a substitute, just ask that the high-fat food be left off your plate.

? Ask for low-calorie items, such as salad dressings, even if they?re not on the menu. Vinegar and a dash of oil or a squeeze of lemon are a better choice than high-fat dressings.
